Fast Track High Court dismisses case against EC

The Fast Track High Court hearing a suit brought against the Electoral Commission, EC, by two persons over the creation of forty five new Constituencies, has declined jurisdiction on the case and accordingly, dismissed the application.

The court presided over by Justice Ofori Attah, advised that the case be sent to the appropriate forum, which is the Constituency Boundary Dispute Settlement Tribunal for hearing.

Following the decision by the EC to create 45 new Constituencies, the Plaintiffs, Richard Odun-Quaye and Daniel Quaye filed the application to restrain the Commission from proceeding with the exercise.

The application sought, to compel the EC to publish a Constitutional Instrument setting forth the basis process and methodology by which it sought to create, renew or alter the Constituencies as per the provision of the Constitution.

The plaintiffs also believed that the Commission's principle, that every district must have a constituency is not warranted, by either the constitution or any other law.

The EC had also filed an application to stay proceedings at the court, on account that some aspects of the case needed to be interpreted by the Supreme Court.

Justice Ofori Atta declined the application to stay proceedings,  that the application did not border on Constitutional matters but on boundary related issues.
